MANCAFE LICENSE AGREEMENT
This agreement is valid for ManCafe Server products, websites, programs, and operational applications such as the official website, blogs, mobile application, and social media pages.
PLEASE READ CAREFULLY
It is important for you to read the rights and obligations indicated in this license agreement. You will be asked if you accept these regulations at the time of configuration. If you do not accept, the software will not be installed to your computer /server . If you install and use this program, it means that you have read the agreement obligations and accepted. You should first accept the license agreement below in order to use the program.
This agreement is a legal agreement between TIK SYSTEMS and END USER- (real or corporate person) for MANCAFE SERVER (software) or MANCAFE GUIDE (Mobile App) (will be called MANCAFE in short). If you install the software in your computer, it means you have accepted the requirements of the agreement. In case you do not accept the agreement, you cannot install and use the software.
‘END USER’ who uses our software, websites, Mobile applications or any other services we provide must be 18 years of age or older
THE VERSION THAT YOU ARE NOW CONFIGURATING IS DISTRIBUTED FOR FREE. ALL RIGHTS OF ADVERTISEMENT DISPLAY, BEING THE OPENING PAGE OF ANYKIND OF INTERNET BROWSER UPDATES AND THE INCOMES BY MEANS OF THE SOFTWARE ALL BELONG TO THE TIK SYSTEMS. TIK SYSTEMS, RESERVES ANY RIGHTS AND PROFITS THAT WILL COME THROUGH THESE VERSIONS. IF YOU DO NOT OBEY TO INSTALL THE PROGRAM UNDER THESE CIRCUMSTANCES, PLEASE CANCEL THE CONFIGURATION WIZARD.
I- RIGHT AND REQUIREMENTS OF THE “END USER”
1. ‘END USER’ is obliged to license the MANCAFE on the direction of the license information in the e-mail that has been sent to him.
2. ‘END USER’ ACCEPTS ALL THE INFORMATION THAT IT DECLARED WHILE HE WAS HAVING THE LICENSE APPROVED ONLINE IS TRUE AND COMPLETE IN ORDER to use MANCAFE.
3. ‘END USER’ is not allowed to turn over the MANCAFE license, sell, rent or lend.
4. MANCAFE server/client is software that is developed in accordance with its architecture. The number of clients indicated while demanding license, determines how many computers the ‘END USER’ has in the enterprise. ‘END USER’ may set clients in as many computers as it indicated. Through this agreement, ‘END USER’ will obtain the right of using the aforesaid program only in the indicated computers. For each license, only one server can be set and used.
5. ‘END USER’ is sole responsible for any information, statement or fault state that it gives while using the license. In the direction of these statements and information, any kind of material and moral risks, punishments, actions, warnings, compensations and decisions are in END USER’S responsibility and obligation. TIK SYSTEMS have no responsibility and obligation.
6. ‘END USER’, without informing TIK SYSTEMS, has the right to quit, give up the use of the software whose license it has got, or "END USER" can restart using it. In this case, neither sides can demand any fees, compensation or any other material or moral payment.
7. ‘END USER’ does not have to pay anything to TIK SYSTEMS to use the version that they published with "free" addition.
8. TIK SYSTEMS, does have right of "changing, setting, altering, using start-pages/home-pages of installed internet browsers; show advertisement in MANCAFE user interface or in installed browsers; show a welcome screen or a website in a browser or in MANCAFE user interface, with or without ads; advertise or promote TIK SYSTEMS's or other COMPANIES' products or websites", to active users or customers, in the computers that MANCAFE Server or Client installed, without informing the ‘END USER’. TIK SYSTEMS does have right to make profit and make that profit reserved. TIK SYSTEMS does not have to share or distribute the profit that it makes from the software, MANCAFE. ‘END USER’ cannot demand any shareholding from this profit.
9. ‘END USER’ is obliged to provide the security of the computers and enterprise that it owns. MANCAFE is not required to protect the computers against the viruses, trojans or other harmful software and applications because it is not an anti-virus software. ‘END USER’ does have to take its own measures against the evil-minded customers. TIK SYSTEMS is never responsible for any damages of any of the computers or immovable-movable properties that ‘END USER’ has in the enterprise or network.
10. ‘END USER’ accepts, declares or undertakes (the followings):
a. not to copy and use MANCAFE and documentation outside this license agreement, not to convert the MANCAFE to a source code or/and do reordering process, not to subject the program to the reverse engineering processes, not to make changes on the program, not to interfere the original construction of the software by using other software or techniques, not to use illegally, not to give the license info to the third persons, to inform TIK SYSTEMS immediately incase of the situations like loss or steal of the license information or passwords or e-mail address registered in the license.
b. Not to distribute MANCAFE to other real/corporate persons, firms, not to lend, hire, sell or open to the public.
c. Not to change MANCAFE and its documentation, adapt or create something similar or different by being inspired from the MANCAFE and documentation.
d. Not to demand any fees, compensation, etc. in any cases.
e. Not to block or try to block the advertisements, announcements, opening pages which are displayed and published by MANCAFE, not to separate MANCAFE from these plug and advertisement elements in any ways without informing TIK SYSTEMS, not to censor the plug elements by using other software or techniques, also not to use fake clicking programs or boots that will increase the display number of the advertisements in contrary to the reality.
f. 'TIK SYSTEMS's not to share positive or negative critiques, written declarations, messages, e-mails, etc. including any assault, insult, abuse, etc. about 'TIK SYSTEMS' shareholders and/or MANCAFE with third persons and do any provocation in any platform as well as internet.
g. MANCAFE will not follow and save the information or data that removes the private life of anyone in the network area in which it is configured. All the uses this extent, will constitute as a crime according to the legal principles that regulate off-licensed software uses and copyrights. TIK SYSTEMS has unilaterally the right to abolish this license completely by reserving any of its legal rights, or it can suspend the use of license temporarily, or even demand the necessary penal and material compensations.
II- THE RIGHTS AND OBLIGATIONS of 'TIK SYSTEMS'
1. in case the ‘END USER’ behaves in adverse with the requirements 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, part I, TIK SYSTEMS has the rights to use any kind of legal applications and demands without any warnings. ‘END USER’ has the right to get a copy as a spare one.
2. ‘TIK SYSTEMS’, may give a technical support to the ‘END USER’ if demanded. The intellectual rights of the materials and information obtained and developed during support service belongs to TIK SYSTEMS and ‘END USER’ cannot demand any rights about this.
3. ‘TIK SYSTEMS’ does not demand any payment from the ‘END USER’ for the version that it published for FREE.
4. ‘TIK SYSTEMS’ has the right to stop its service without feeling obliged to inform.

5. ‘TIK SYSTEMS', has the right to suspend/remove the software license without warning or showing to the ‘END USER’.
6. 'TIK SYSTEMS', has the right to display advertisement on computers in Which MANCAFE is used, make a profit, reserve the profit that it makes, displaying advertisements on the browsers, change installed browser's home-page/start-page, change MANCAFE online and update it.
7. TIK SYSTEMS assures to keep the information of MANCAFE users and other data secret and not to share anybody or institution except the demands from authorized and official agencies.
III- VALIDITY OF THE AGREEMENT
The duration of this agreement is one year after its confirmation. Incase there are not mutual use and/or cancellation of license, duration automatically extends 1 (one) more year. LAST USER’S installing MANCAFE server or client in his computer or computers, applying through the internet to use the software, mean that he/she accepts this agreement and any changes which can be made in the agreement.
IV- TERMINATION OF THE AGREEMENT, CANCELLATION
Both sides have the right to terminate the agreement without feeling obliged to give an oral or written warning. In case of a cancellation, END USER assures declares not to use the program MANCAFE until a second agreement is accepted. ‘TIK SYSTEMS’ has the right to reserve its profits, user information, etc. secret and not to share.

1. For the premium (paid) version of the MANCAFE server software, we offer the service as soon as the payment is processed and the END USER will be provided with an invoice sent automatically to their registered email address. Given that any payments for the premium version is non refundable.
2. In case of service termination by either party, any fees associated with the purchase are non-refundable.

3. The validity of the Premium version is one month. After that month of subscription, the END USER have the right to continue with the service or terminating the premium version and will be switched automatically or manually to the FREE version.
